Service Agreement & Terms of Use
America’s Auto Appraisers
By ordering an appraisal from America’s Auto Appraisers (“Company”, “we”, “our”), the client (“you”, “your”) agrees to the following terms:
1. Services Provided
America’s Auto Appraisers provides professional auto appraisals, including but not limited to standard appraisals, diminished value reports, total loss valuations, and expert witness services. Our reports are based on our independent professional opinion, research, and expertise.
2. Fees & Payment
All fees for services are due in full at the time of order unless otherwise agreed in writing. Once services commence, fees are non-refundable except as set forth in our Refund Policy below.
3. Refund Policy
Our refund policy is as follows:
Prior to Service Commencement: A full refund will be issued if you cancel in writing before we begin work (including research, document preparation, or inspection).
After Service Commencement: A partial refund may be granted at our discretion. A minimum non-refundable service fee of $100 or 25% of the appraisal fee (whichever is greater) applies.
After Appraisal Completion: No refunds are provided once the appraisal report is delivered.
Diminished Value Appraisals: No refunds will be issued if your insurance company, its appraisers, or adjusters decline or limit your claim, regardless of timing, liability decisions, prior damage, or other claim-related factors beyond our control. Our obligation is to provide a high-quality, professional appraisal, not to guarantee a particular insurance outcome.
Refund Request Compliance:
Refund requests must be submitted in writing to kj@americasautoappraisers.com within 7 calendar days of the event giving rise to the request. Failure to comply with this procedure and timeline will result in forfeiture of any right to a refund.
4. Client Responsibilities
You agree to provide accurate and complete information relevant to the appraisal. The Company is not responsible for delays or inaccuracies resulting from incomplete or incorrect information provided by you.
5. Limitation of Liability
Our appraisals represent our professional opinion and are provided “as is.” We are not liable for any decisions made by insurers, third parties, or other entities relying on our reports. In no event shall our liability exceed the fee paid for the appraisal service.
6. Governing Law
This Agreement shall be governed by the laws of the State of Colorado. Any disputes arising under this Agreement shall be resolved in the courts of competent jurisdiction within Colorado.
7. Acknowledgment
By ordering our services, you acknowledge and agree to these Terms and Conditions, including the Refund Policy.
